Most restaurants assume trade effluent rules don't apply to them, and in most cases, they're right. Ordinary kitchen wastewater from cooking, washing and cleaning is classed as domestic sewage, not trade effluent. But that doesn't mean your kitchen is free from drainage compliance risk.

Where restaurants actually run into trouble is fat, oil and grease (FOG) entering the sewer network. Under the Water Industry Act 1991, water companies have the power to take action against premises whose discharges cause blockages or damage to the public sewer, and grease-related blockages are one of the most common triggers.

Do restaurants need trade effluent consent?

For most restaurants, pubs, cafés and takeaways, the answer is no. Trade effluent consent applies to businesses producing waste beyond ordinary domestic sewage, things like manufacturing, metal finishing, car washes or launderettes. Wastewater from a standard commercial kitchen, washing up, food prep and cleaning, is generally treated as domestic sewage.

That said, water companies can still take enforcement action if your discharge causes problems in the network, regardless of whether trade effluent consent applies.

Where the real risk comes from

The most common issue for restaurants isn't a consent breach, it's fat, oil and grease build-up causing blockages in the sewer network. This matters because:

  • Water companies can pursue cost recovery from businesses identified as the cause of a blockage
  • Repeated or significant blockages can trigger closer scrutiny of a premises' drainage practices
  • Local authorities can take action separately if poor drainage practices create a public health or environmental issue
  • In serious cases, discharges causing pollution can fall under Environment Agency enforcement, which carries far higher penalties than routine sewer issues

In short: it's rarely the paperwork that catches restaurants out, it's what's actually going down the drain.

What most commonly causes problems

  • No grease trap, or an undersized one for the volume of food being prepared
  • Grease traps that aren't serviced regularly, allowing FOG to pass straight through
  • Staff pouring fat or oil directly down sinks, bypassing the trap altogether
  • Food waste entering drains via sinks without adequate straining
  • No documented servicing history, making it harder to demonstrate good practice if a blockage is investigated

How to avoid enforcement risk

  1. Install a correctly sized grease trap for your kitchen's output, not just whatever came with the building
  2. Set a servicing schedule based on your actual volume, rather than guessing or waiting for problems to appear
  3. Train staff on what shouldn't go down the drain — fat, oil, food scraps and cleaning chemicals in large quantities
  4. Keep servicing and maintenance records, which can help demonstrate good practice if your drainage is ever queried
  5. Fix recurring blockages properly, rather than repeatedly clearing the symptom without addressing the cause
